Terms of Service

These terms govern the use of visigraphic.com and the services of Visigraphic: website development and redesign, Drupal development, logo and branding design, SEO and content strategy, website maintenance, and hosting. By using our site or services, you agree to these terms. For each project, a mutually agreed quotation or written agreement takes precedence where it differs from these terms.

1. Use of this site

Information on this site is general in nature. Results from the Cost Estimate calculator are initial estimates, not binding quotations.

2. Quotations and agreements

Scope, fees, timeline, number of revisions, and payment terms are set out in the quotation. A project starts once the quotation is approved in writing (including by email or WhatsApp) and any required initial payment has been received. Requests outside the agreed scope are charged separately.

3. Client responsibilities

Clients provide the required materials (text, images, logos, account access) on time and warrant that they have the right to use them. Delays in materials or approvals may shift the project schedule.

4. Payment

Payments follow the terms in the quotation. Late payment may delay work or, after notice, lead to suspension of hosting and maintenance services. Third-party costs such as domains, licenses, premium plugins or themes, and advertising are borne by the client unless stated otherwise.

5. Intellectual property

Upon full payment, rights to designs and content created specifically for the client pass to the client. Drupal and open-source modules remain under their own licenses (GPL), and third-party assets such as stock photos or fonts follow their respective licenses. We may show completed work in our portfolio unless the client asks us not to in writing.

6. Hosting and domains

  • Domains are registered in the client's name where possible; timely renewal is handled as set out in the agreement.
  • We aim to keep services available but do not guarantee uninterrupted service during maintenance or outages at infrastructure providers.
  • Hosting may not be used for illegal content, spam, malware, or copyright infringement; we may suspend the service if this occurs.
  • We make regular backups, but clients are still advised to keep their own copies.

7. Warranty and support

Bug fixes during the warranty period are provided as stated in the quotation. The warranty does not cover changes made by others, effects of third-party updates, or requests for new features.

8. SEO

We apply sound SEO practices but cannot guarantee specific search engine rankings, as the algorithms are outside our control.

9. Limitation of liability

To the extent permitted by law, our liability is limited to the fees paid for the service concerned. We are not liable for indirect losses such as lost profits or data, except where caused by our gross negligence.

10. Confidentiality

We keep confidential the information, data, and access that clients entrust to us.

11. Termination

Either party may end the engagement by written notice. Work already performed remains payable. When a hosting service ends and all invoices are paid, we hand over a copy of the website files and database.

12. Governing law

These terms are governed by the laws of the Republic of Indonesia. Disputes will first be settled amicably; if no agreement is reached, through the Surabaya District Court.

13. Changes to these terms

We may update these terms from time to time. The latest version is always available on this page.
